Occupy The Justice Department Challenges Obama Administration Integrity on Prosecutor Misconduct Issue

One of the issues driving protesters participating in the April 24, 2012 Occupy The Justice Department demonstration is an issue that U.S. Attorney General Eric Holder knows well: prosecutorial misconduct.

Holder knows this misconduct issue well because he has criticized it during congressional testimony, in fact as recently as March 2012 when he was commenting on a special prosecutor’s report castigating the wrongdoing of federal prosecutors.

That wrongdoing, Holder acknowledged, unlawfully tainted the corruption investigation and 2008 trial of the late U.S. Senator Ted Stevens, who was convicted of corruption in his home state of Alaska.

Protesters, including fiery Philadelphia activist Pam Africa, want Holder to take action against the prosecutorial misconduct evident in scores of unjust convictions that have led to the wrongful imprisonment of political prisoners across America, most of them jailed for two or more decades.

Those political prisoners – ignored domestically while exalted abroad – include Native American activist Leonard Peltier, Puerto Rican Nationalist Oscar Lopez Rivera, the Cuban 5, author/activist Mumia Abu-Jamal and other former Black Panther Party members like the Omaha Two (Ed Poindexter and Mondo W. Langa).

The Proof's in the 'Puddin': Plays, Prose and Connecting the Dots of Prejudice

I believe that absolutely nothing happens in a vacuum.

There is always a connection between why things happen and the something (or someone) that made it happen. All too frequently that connection is not easily apparent, and that creates problems.

I’m convinced there is a connection between the contemporary television shows like “Axe Men,” “Ice Road Truckers”, “Swamp People”, “Hillbilly Noodling”, “Sarah Palin’s Alaska” and a play entitled, “Puddin’ Head.”

The Department of Theater at Temple University in Philadelphia, staged that play – containing racist content – as its contribution to Black History Month this year.

“Puddin’ Head” is a stage-adapted version of a novel published in 1894 by Mark Twain originally entitled The Tragedy of Pudd’nhead Wilson. This work examines race, class, slavery, and rape from the perspectives of the time it was written in the 19th Century. This work uses the N-word and/or other racist stereotypes in almost every other sentence.

It’s a challenge to make adult sense of the absurdities coming out of Colombia right now.

I had first planned to write about the Drug War aspect of President Obama’s summit meeting in Cartagena, since it’s quite amazing when the right-wing president of Colombia publicly lobbies the US president to shift the Drug War from military operations against supply in Latin America to a more social approach against demand in the US. After all, Colombia is the highly militarized US showcase nation in the 40-year Drug War.

“Despite all of the efforts, the immense efforts, the huge costs, we have to recognize that the illicit drug business is prospering,” Colombian President Juan Manuel Santos told the attending leaders. He even advocated a process of decriminalization, though he recognized this was only a “starting point to begin a discussion that we have been postponing for far too long.”

This is real news.

Our Drug War is a military/police enterprise focused on attacking the supply of drugs coming from Latin America. Santos seems to concede it’s a dismal failure. He also knows the accumulated conditions of that failure are so entrenched in the hemisphere that it’s hard to even begin to discuss a way out.

Barack Obama’s administration is so cowed by entrenched, die-hard drug warriors that it’s doubling down on marijuana busts as local governments across the nation go the other way and ease enforcement of marijuana laws. The Feds are like fundamentalist puritans who see the decriminalization of marijuana as the social equivalent of a “gateway drug” leading to crack-addict Hell. There’s a desperate need for a much more pragmatic approach.

Trolling for Kids: The Empire is Using Hard Times to Help it Recruit More Imperial Troops and Cannon Fodder

In the militarist society in which we live in these latter days of American Empire, all soldiers are “noble heroes” who have signed up at “great personal sacrifice” to “defend our freedoms,” and we are all expected to pay homage and a great deal of our hard-earned money to support them, both in their brutal efforts to subjugate people in desperately poor parts of the world, and (when they leave the service, either to take jobs in the private sector or to live out broken lives if they were wounded) as veterans.

But let’s be honest about all this.

Most of the men and women in the military didn’t join the US armed forces out of any noble motives. They joined because there are no jobs to be had, and the military is taking pretty much anybody who’s willing to sign on the dotted line (they’re begging for recruits). Or they joined because of the promise that they would get trained for a better career, at government expense. Or, like one kid I know, they joined for the excitement.

Just today I got a phone call from a recruiter asking if I was “interested in learning more about the Army.” I don’t know if he was so hard up he was hoping to sign a 63-year-old war resister, or whether he thought he had my 18-year-old son on the phone.

But looking at a Navy recruiting flier that came in the mail the same day addressed to my son, it’s clear that the Pentagon is not trusting to patriotic fervor to lure its new cannon fodder.

Yes, The 99% Spring Is A Fraud

With hindsight gained by googling “MoveOn” and “co-opt” after the fact, I can’t claim that nobody tried to warn me. Many websites with left and even liberal politics had said in so many words, “Be wary of this organization called the 99% Spring. It is a Trojan horse for the Democrats.” I just didn’t read that anywhere in a timely fashion. I’ve had a lot of stuff on my plate lately. That’s my excuse. And in my ignorance, I responded to some spam about “nonviolent direct action training” organized by MoveOn and got invited to this 99% Spring thing on April 10 at the Goddard Riverside Community Center in Manhattan. Somebody even called me all the way from San Francisco to make sure I was a sincere seeker on the left and would be attending, along with 120,000 others in training sessions around the country.

Which I did. The meeting was a few blocks from where I live. The spam said it was “inspired by Occupy Wall Street.” I wasn’t sure what that meant, but I was vaguely hoping that whatever the 99% Spring was, it would start a chapter of Occupy Wall Street on the Upper West Side, conveniently near my abode, and agitate for the Democrats and MoveOn to move left.

The first clue that my evening might go otherwise was the sign-up table, where there were a bunch of Obama buttons for sale and one sign-up sheet for the oddly named Community Free Democrats (are they free of community?), which is the local Democratic clubhouse. That killed the “inspired by Occupy Wall Street” vibe right there. No piles of literature from a zillion different groups, as there had been in Zuccotti Park. No animated arguments among Marxists, anarchists, progressives, punks, engaged Buddhists, anti-war libertarians and what have you. Just Obama buttons, which didn’t appear to be selling.

The Potential Killers All Around Us

I’ve often wondered why so many innocent people who are shot by police end up dead.

Granted that police officers spend a fair amount of time training with their service revolvers, and are thus likely to be better shots with a pistol than your average gun-owner. But even so, in so many cases where some unarmed person is shot by police, the result is death, and it makes you wonder how cops, often in the dark and on the run, manage with their notoriously hard-to-aim pistols to hit a vital organ with such depressing regularity.

The answer, I’ve learned, is that police in most jurisdictions these days routinely use hollow-point bullets, which are designed to do maximum damage to soft tissue targets. Because the tip of the projectile is composed of hollowed-out lead, it flattens on impact and spreads out, vastly enlarging the hole made upon entry into a body, causing catastrophic damage to vital organs, internal bleeding and wounds that are hard to repair even in an emergency room.

Just recently, as reported below, we learned that the Department of Homeland Security, a super-agency established by Congress and the Bush-Cheney administration in the wake of the 9-11 attacks, had ordered 450 million rounds of .40 caliber hollow-point ammo, which will reportedly be used at a rate of 90 million shells a year over the five-year life of the contract. (That represents one bullet for every American citizen over the course of the next four years! And it’s in addition to another 100 million rounds purchased two years earlier, plus 200 million rounds just purchased by the US Justice Dept.)

Hi-Ho! The US is a Police State

Back in the early 1980s, I had the extraordinary good fortune to get to meet one of my literary heroes, Kurt Vonnegut, up close and personal. We shared a police wagon, sitting next to each other for a ride to the station to be booked for blocking the door to the South African consulate in a demonstration against that country’s then policy of white rule and apartheid.

I can’t say I got to know the author very well, but he was quite friendly and interesting to talk to, and after our arrest and booking was over, and we were released, I shared a cab as far as his house.

I got to thinking that thanks to the latest outrageous 5-4 decision by the US Supreme Court (supported fully by our Constitutional law-teacher President Barack Obama and his Solicitor General), which says it is now perfectly okay for police to strip-search innocent people picked up on any charge — even a traffic offense or a leash-law violation, or alleged failure to clear a warrant for a bald tire — had Kurt and I been busted for the same kind of protest today, we’d “know” each other much more intimately. For example I’d probably know if Vonnegut had hemorrhoids, and he’d know about a patch of skin discoloration on my balls.

The Trayvon Martin story is not going to go away. It was a narrative event waiting to happen, and the story only gets richer with meaning as time goes on. There are the obvious racial aspects, but the most important elements are about police power versus citizen power — and who can get away with shooting whom.

Since the police and the various paralegal and wannabe versions of police are the first-line of contact between individuals and The State the incident’s outcome is important in the struggle between citizens’ rights and state power.

So far, the police and a flawed criminal justice system are winning most of the battles.

The Supreme Court just ruled five to four that police departments and jail officials have the right to strip search anyone once the person is ensconced in their clutches. These five male robed eminences agreed it was just fine for a police officer to make you stand in a room buck-naked, lift your nut sack, bend over and spread your cheeks. The officer doesn’t need a reason, other than having you in his control. It’s an elitist ruling ripe for abuse.

Extorting Alums: Colleges Withhold Transcripts from Grads in Loan Default

More than ten years ago, Pedro Rodriguez, a talented keyboard musician, came from his colonial homeland of Puerto Rico to go to Temple University. From a low-income family, he depended heavily on student loans to finance his four-year undergraduate study. Graduating summa cum laude with a bachelor’s of music, he went on to earn a master’s degree in music from Temple and then was hired for three years to teach there as an adjunct. By the end of college, he was $62,000 in debt but was making payments regularly until Temple laid him off, allegedly because of budget cuts. That’s when his problems began. (Pedro Rodriguez is a pseudonym to protect his identity.)

Unable to find a job as a music teacher in the current economic crisis, he eventually went into default on his loans, which included Stafford, Perkins and private bank loans. Then this year, he decided to go on to earn a PhD, which would make it possible for him to get hired in his field. He applied to a top-rated university in the Northeast, but when it was time to send his school transcripts, Temple froze him out. “They said as long as I was in default on my loans, they would not issue a transcript!” says Rodriguez.

A spokesman from Temple confirms that it is school policy to withhold official transcripts from graduates who are in default on their student loans. As it turns out, the school is not alone; this is the position taken by most colleges and universities, though there is no law requiring such an extortionate position. They do this despite the fact the colleges themselves are not out the money. They have received the students’ tuition payments in full and are in effect simply acting as collection agencies for the federal government.

The US Department of Education says only that it “encourages” colleges to withhold transcripts, a tactic which the department, in a letter to colleges, claims coldly “has resulted in numerous loan repayments.”
